These terms of use apply to the SaaS offering “smart-tutorials”, provided by codegarden software GmbH. By using “smart-tutorials” you agree to these conditions.

2. Purpose and functionality
"smart-tutorials" offers a platform for interactive learning content and tutorials, allows users to upload their own videos and convert them into smart tutorials using AI technologies. The completed tutorials can then be downloaded. codegarden does not guarantee that the AI-generated content corresponds exactly to the user's specifications.

3. Target group and usage
The platform is aimed at anyone who wants to create and use interactive and personalized learning content. Users undertake not to upload any content that glorifies violence, pornography or illegal content and assure that they have the necessary rights to edit and publish the content.

4. Data protection
"smart-tutorials" takes data protection seriously and processes personal data and content in accordance with applicable data protection laws and solely for the purpose of providing and improving the Services.

5. Disclaimer and Limitation of Liability
codegarden provides “smart tutorials” on an “as is” and “as available” basis. Users assume full responsibility for the content they create and upload. codegarden is not liable for any non-compliance of the AI-generated content with user specifications or for any direct, indirect or consequential damages that may result from the use of the platform.

6. Copyright, Usage Rights and Restrictions
The copyright and right of use of the smart tutorials generated remain with the user, as they are based on the information they provide. codegarden and other users have no right to use this content without the consent of the author. Users are granted a non-exclusive right to use the Platform and edit their own content, provided that they do not violate the rights of third parties.

7. Changes to Terms of Use
Changes will be communicated on the platform or by email. Continued use after any changes constitutes acceptance of them.

8. Governing Law
German law applies to these terms of use and the use of the platform.

9. Additions
codegarden reserves the right, at its sole discretion, to exclude users from using the platform at any time, in particular in the event of violations of these Terms of Use or legal provisions.
